Terms and Conditions

I. Introductory Provisions

THE CLINIC s.r.o. (ID: 46349031, Na Florenci 2116/15, Prague 1) operates as a non-state healthcare provider under Czech Act No. 372/2011 Coll. and provides dental services not covered by public health insurance. Care is delivered through healthcare professionals including dentists, dental hygienists and other workers under employment or contractual relationships.

These Terms and Conditions serve as general commercial terms under the Civil Code and form part of the healthcare service agreement between the company and the patient. For minor patients, their legal guardian bears responsibility for fulfilling patient obligations.

II. Contract Formation

Healthcare service agreements are concluded orally for each specific service listed in the price list. An initial examination requiring a separate agreement is a prerequisite for commencing care.

Patients must present identification (insurance card, ID card, passport) and complete an information form including personal data, medical history questionnaire and price list acknowledgement.

Appointments may be booked by phone, in person at the facilities, by email or via the website. The company reserves the right to cancel confirmed appointments for operational reasons, with immediate notification and an alternative date proposal.

The final price for healthcare services provided will be calculated by the responsible professional after service delivery, based on the complexity, time required and difficulty of the procedure.

III. Payment Terms

Payment is due immediately after service completion at the clinic reception, by:

  • Cash
  • Card
  • Bank transfer (with approval of the responsible professional)

A receipt signed by the responsible professional is issued for each payment. Late payment interest of 0.02% of the outstanding amount per commenced day of delay applies.

IV. Company Obligations

The company undertakes to provide quality, safe healthcare in accordance with applicable regulations and professional standards, and to inform patients about service options and their consequences.

V. Patient Obligations

The patient is obliged to:

  • Follow the established treatment plan
  • Provide cooperation and truthful information about their health
  • Disclose all relevant health facts and not withhold information
  • Maintain confidentiality about information obtained during treatment
  • Consent to photographic documentation for health records
  • Behave appropriately so as not to disrupt clinic operations or cause harm
  • Truthfully inform about health status, medical history, allergies and medications
  • Follow professional recommendations and instructions

Non-compliance with obligations regarding the treatment plan and health disclosure may reduce the company's liability for health damage under §2643 of the Civil Code.

VI. Warranty

Dental procedures: The company does not provide warranties on dental examinations, treatments, fillings, hygiene or whitening. It guarantees proper professional execution. Dissatisfied patients may request corrections or file complaints under the Healthcare Services Act.

Dental products: Patients are entitled to claim defects within twenty-four months of acceptance for bridges, dentures, crowns and implants.

Patients are entitled to free remedial correction for valid claims. The warranty does not cover:

  • Defects caused by normal wear, chemical exposure or extreme physical conditions outside the product design
  • Failure to maintain oral hygiene or attend biannual cleanings and preventive examinations
  • Non-compliance with the treatment plan or improper product use
  • Systemic diseases affecting health (diabetes, osteoporosis, etc.)
  • Head, mouth or jaw injuries following service provision
  • Insufficient patient cooperation in treatment
  • Defects caused by prior or subsequent services from other providers

VII. Reminder Service — Visit Watching

The company operates a free "Visit Reminders" service — automated email reminders for preventive check-ups and dental hygiene. The service is available to anyone via the website and does not require being a patient of the company.

To start the service, the user enters an email and selects which visits to be reminded about (preventive check-up at 6-month intervals, dental hygiene at 3-month intervals). Optionally, the approximate interval since the last visit may be provided. Reminders are sent at the interval recommended for the given type of care.

After form submission, an activation email with a link is sent — the service starts only after this link is confirmed (protects against misuse of someone else's address). Without activation, no further data is processed.

The user may cancel the service at any time by clicking the unsubscribe link in the footer of every email, or change settings (selected services, sending time) via the "Change settings" link in the footer. User data is processed solely for the purpose of sending reminders and is deleted upon unsubscription.

Marketing consent for newsletters and offers is separate and entirely optional — the service works the same without it.

Operational emails of the service (activation, reminders) are not considered commercial communications under Czech Act No. 480/2004 Coll. — they are the fulfilment of a service requested by the user.

VIII. Final Provisions

By signing the agreement, the patient consents to anonymous publication of clinical photographs in professional literature, journals, social media and professional discussions, with the right to revoke consent at any time.

The company maintains liability insurance (Policy No. 1200130657 with Pojišťovna VZP, a.s.) covering healthcare provider damages.

Agreements are exclusively governed by Czech law (Civil Code). If any provision becomes invalid, the others remain in force.

The company reserves the right to amend these terms; agreements are governed by the version in effect at the time of signing.
